Azerbaijan improves legislation on hereditary transmission

The legal framework regarding inheritance transmission—specifically, the right of the heir of a deceased heir to receive a share from the original estate after the opening of the inheritance—has been improved., APA reports.

This is reflected in the amendments to the Civil Code approved by the President of the Republic of Azerbaijan, Ilham Aliyev.

According to the Code, if the heir dies after the opening of the inheritance, the right of the deceased heir to inherit a share from the original testator shall pass to the heirs of that deceased heir as part of the inheritance property according to the general rules.

If the period set for the deceased heir's heir to refuse the inheritance is less than three months, that period will be extended up to three months.

Thus, hereditary transmission, i.e., the legal basis for the right of the heir's heir to inherit a share from the original testator upon the death of the heir after the opening of the inheritance, has been improved and determined not to be limited by the inheritance acceptance periods.
