Azerbaijan bans import, production and sale of electronic cigarettes

The import, export, production, storage, wholesale and retail sale, and use of electronic cigarettes and their components are prohibited, APA reports.

This is reflected in the proposed amendment to the Law “On Tobacco and Tobacco Products,” which was put up for discussion at today's session of the Milli Majlis.

Under the draft law, nicotine-containing electronic cigarettes are included in the definition of tobacco products.

An electronic cigarette is defined as a product intended for use through a device—whether with or without a mouthpiece or other components, including a cartridge or refill container—that delivers vapor containing nicotine or not containing nicotine into the human body via inhalation, excluding food products, tobacco products, medicines and medical devices.

Electronic cigarette refill containers may be used once or multiple times, or they may be refilled using disposable cartridges.

Heated tobacco products will not be classified as electronic cigarettes. A heated tobacco product is defined as a product consisting of tobacco (or a tobacco mixture) and non-tobacco components used in its manufacture, intended to deliver a nicotine-containing aerosol into the human body through inhalation during a heating process, without ignition and without the formation of tobacco smoke.

Accordingly, nicotine-containing electronic cigarettes will be classified as tobacco products, with their circulation prohibited.

The clarification of definitions and the introduction of new terms will allow for more precise classification and differentiation of tobacco products—including heated tobacco products—as well as electronic cigarettes in legal enforcement and regulatory practice.

At the same time, as part of the harmonization process, relevant amendments are being made to the Tax Code of the Republic of Azerbaijan and the Law of the Republic of Azerbaijan “On Advertising.”

These include the removal of “single-use electronic cigarettes” and “liquids for electronic cigarettes” from the list of excisable goods and, as a result, the abolition of the corresponding tax rates, as well as the alignment of advertising-related prohibitions with the newly defined terms.

The draft law was put to a vote and adopted in the third reading.

If the law is passed, it will come into force on April 1, 2026.
