Azerbaijan sets new obligations for schools and healthcare institutions to protect children from violence

A new obligation is being established for educational and medical institutions to protect children from violence, APA reports.

This is reflected in the new draft law “On Children’s Rights,” which was put up for discussion at today’s meeting of the Milli Majlis Human Rights Committee.

According to the draft, every child has the right to protect their honor and dignity. Insulting children and degrading their honor and dignity is prohibited. Violence against children is prohibited in the family, in educational, medical, social service, sports, cultural, and recreation institutions, in penitentiary institutions, and other places where a child may be present, as well as in internet information resources and information and telecommunications networks. A child has the right to be protected from violence. The state takes legal, administrative, social, and educational measures to prevent violence against children.

Parents (or persons acting in their place), as well as employees of educational, medical, social service, sports, cultural, recreation, and penitentiary institutions responsible for supervising children, must, while observing confidentiality, report signs of violence against a child to the relevant law enforcement authorities or to the local commission for the protection of children’s rights in the respective area, and may also report the case to the child hotline service. Parents (or persons acting in their place), as well as officials of state bodies (institutions), medical institutions, law enforcement authorities, and other competent bodies, are obliged to take all necessary measures to restore the physical health and psychological condition of a child who has been subjected to violence.

State bodies (institutions) and local self-government bodies, as well as legal entities and officials, shall take measures to carry out awareness-raising and promotional activities on child protection and children’s rights among persons who are in regular contact with children in the fields of education, healthcare, social protection, law enforcement, sports, media, culture and recreation, and to instruct such persons on methods for identifying children who have been subjected to violence.

Mechanisms are established in educational, medical, social service, sports, cultural, and recreational institutions, as well as in penitentiary institutions, to prevent violence against children, including persistent pressure and aggressive behavior of children against one another, and to apply effective response measures in the event violence occurs.

Under the current law, state and local self-government bodies, as well as legal entities and officials, take measures to raise awareness of child protection and children’s rights among persons who are in regular contact with children in the fields of education, healthcare, social protection, the judiciary, law enforcement, sports, culture and recreation, and to instruct such persons on methods for identifying children who have been subjected to sexual exploitation and sexual violence.

Awareness-raising and promotional activities are carried out among persons who are in regular contact with children regarding opportunities to report, by observing confidentiality, to the bodies protecting children’s rights when there are grounds to believe that a child has become a victim of sexual exploitation or sexual violence.

Persons convicted of crimes related to sexual exploitation or sexual violence against children may not be hired (appointed) or involved in work that entails regular contact with children.

Children who have been victims of sexual exploitation or sexual violence enjoy the rights and guarantees provided for child victims of human trafficking.
