Actions that clearly express disrespect toward society, but are not accompanied by the use of violence against individuals, or the threat of such violence, or the destruction or damage of another person’s property, will be considered petty hooliganism, and administrative detention and a fine will be applied, APA reports.
This is reflected in the amendments to the Code of Administrative Offenses approved by President Ilham Aliyev.
Under the Code, such petty hooliganism will be punishable by a fine of AZN 50 to AZN 100. Depending on the circumstances of the case and taking into account the identity of the offender, if the application of these measures is deemed insufficient, administrative detention for up to 15 days will be applied.
If actions insulting public morality and clearly expressing disrespect toward society are publicly displayed on an internet information resource or within an information and telecommunications network—namely, the uttering of obscene expressions, making gestures that create such an impression, or displaying parts of the human body in a manner contrary to moral standards and national and spiritual values—a fine of AZN 500 to AZN 1,000 will be imposed. Depending on the circumstances of the case and taking into account the identity of the offender, if the application of these measures is deemed insufficient, administrative detention for up to 30 days will be applied. If the same offense is committed repeatedly by a person who has been subjected to an administrative penalty within one year from the date the decision on imposing the administrative penalty enters into force, a fine of AZN 1,000 to AZN 2,000 will be imposed, and depending on the circumstances of the case and taking into account the identity of the offender, if the application of these measures is deemed insufficient, administrative detention for a period of one to two months will be applied.
The provisions set out in these articles will apply only if the acts specified therein do not give rise to criminal liability under the relevant articles of the Criminal Code.
