Azerbaijan restricts patent protection for designs using state symbols and official insignia

Objects that contain, depict, or imitate state symbols (the flag, coat of arms), service marks, their names, and recognizable elements will not be granted legal protection as industrial designs, APA reports.

This is reflected in the proposed amendment to the Law On Patents, which was brought up for discussion at today’s session of the Milli Majlis.

At the same time, objects that contain, depict, or imitate the abbreviated or full names of international and intergovernmental organizations, their flags, coats of arms, other symbols and emblems, as well as the names and recognizable elements of such symbols and emblems; awards, official insignia, control marks, official signs, seals, distinguishing marks, their names and recognizable elements; and the official names, images, or recognizable elements of cultural heritage objects (including ethnic and religious heritage) belonging to any state, without the consent of the relevant competent authority (institution) of that state, will not be granted legal protection as industrial designs.

The draft law was put to a vote and adopted in the first reading.
